Welcome to the POPI App. These Terms of Use govern your access to and use of our self-guided, automated regulatory alignment platform and any related services (the "Service"). By using the Service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the POPI App, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these terms.

2. Use of Service

The POPI App provides tools to assist with POPIA and PAIA compliance. You agree to use the Service only for its intended purpose and in compliance with all applicable laws. The generated documents and templates are for informational purposes and operational alignment; they do not constitute formal legal advice.

3. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

This Privacy Policy explains how the POPI App collects, uses, and protects your personal information when you use our services. We are committed to ensuring that your privacy is protected and in full compliance with the Protection of Personal Information Act (POPIA).

When you register an account, we may collect personal information such as your name, email address, company details, and payment information. As you use the POPI App wizard, we also collect the operational data you input to generate your compliance manuals and policies.

Your information is used strictly to provide the POPI App services, including generating your custom PAIA manuals, privacy policies, and compliance documentation. We may also use your email to send you important account updates, compliance reminders, and security alerts.

3. Data Security & Storage

All data processed by the POPI App is encrypted in transit and at rest. Your information is securely hosted in localized databases under South African jurisdiction. We implement robust physical, technical, and administrative security measures to prevent unauthorized access or data breaches.

This manual is prepared in accordance with Section 51 of the Promotion of Access to Information Act, No. 2 of 2000 ("PAIA") and to address the requirements of the Protection of Personal Information Act, No. 4 of 2013 ("POPIA").

PAIA was enacted to give effect to the constitutional right of access to information held by the State or a private body, provided such information is required for the exercise or protection of any rights. This manual assists requesters in the process of requesting access to information held by Cloud Trainer Pty Ltd (trading as the POPI App).

3. Records Available

We hold records pertaining to our company administration, employee records, financial records, client databases, and IT systems. Certain records are available without a formal request, while others must be requested in accordance with the procedures outlined in this manual and the relevant PAIA regulations.
